This Privacy Policy (this “Policy”) describes the types of information Hack House LLC (“our”, “us” and “we”) may collect from you or that you may provide to us when you download, install, register, access and use the mobile application (the “App”) or our website (the “Site”) and our practices for collecting, using, maintaining, and disclosing that information. We care deeply about your privacy.
This Policy applies to information we collect on or through the App and the Site. This Policy applies only to information we collect in the App and the Site and other electronic communications sent through or in connection with the App and the Site.
This Policy DOES NOT apply to information that:
- We collect offline or on any other company apps or websites.
- You provide to or is collected by any third-party.
Our other websites and apps and third parties may have their own privacy policies, which we encourage you to read before providing information on or through them.
Please read this Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, subscribe to the services we offer through, or use this App. By downloading, subscribing to the services, or using this App, you agree to this Policy. This Policy may change from time to time (see Changes to our Privacy Policy below). Your continued use of this App after we revise this Policy means you accept those changes, so please check the policy periodically for updates.
Children Under the Age of 16
This App is not intended for children under thirteen (13) years of age. No one under the age of thirteen (13) may provide any information to or on this App without parental or guardian consent pursuant to our End User License Agreement. We do not knowingly collect personal information from children under thirteen (13). If you are under thirteen (13), do not use or provide any information on this App or through any of its features, use any of the interactive or public comment features of this App, or provide any information about yourself to us. If we learn we have collected or received personal information from a child under thirteen (13) without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under thirteen (13), please contact us at [email protected]. Canadian residents under thirteen (13) years of age may have additional rights regarding the collection and sale of their personal information. See Canadian Individual Rights below for more information.
What Information Do We Collect?
We may collect several types of information from and about users of this App, which may include:
- Information that can identify you including your e-mail address, payment information (including, without limitation, your name and billing address), or any other identifier by which you may be contacted online or offline (collectively, “Personal Information”);
- Information about you, but that does not individually identify you (“Non-Identifying Information”); and
- Information about your internet connection, the equipment you use to access this App, and usage details.
This information includes:
- Information that you provide us by subscribing to the services offered through the App. We may also ask you for information when you report a problem with the App.
- Records and copies of your correspondence (including email addresses and phone numbers) if you contact us.
- Details of transactions you carry out through the App. You will be required to subscribe to the services before recording any phone calls through the App.
How Do We Collect This Information?
We collect your information:
- Directly from you when you e-mail us;
- Automatically when you use the App or the Site. Information collected automatically may include usage details, IP addresses, and information collected through cookies and other tracking technologies (see Automatic Data Collection Technologies below).
- From third parties, for example, our business partners, who facilitate or provide the services offered through the App.
Automatic Data Collection Technologies
As you navigate through and interact with the App or the Site, we may use automatic data collection technologies to collect certain information about you including:
- Details about your visits to the Site including traffic data, location data, logs, and other communication data and the resources that you access and use on the Site.
- Information about your computer, mobile device, and internet connection, including your IP address, operating system and browser type.
- De-bugging processes that automatically send reports to us and our third-party vendors when the App or the Site crash, which allows us and our vendors to readily make changes and repairs to the App and the Site when necessary.
We also may use these technologies to collect information about your behavior while utilizing the App or the Site including what you click on and where and how you scroll.
The information we collect automatically helps us to improve the App and to deliver better and more personalized content.
The technologies we use for this automatic data collection may include cookies or browser cookies. A cookie is a small file placed on the hard drive of your computer or in your website data on your mobile device. You may refuse to accept cookies by activating the appropriate setting on your browser. Please keep in mind that disabling cookies may alter your usability and the functionality of the App. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to the App or the Site.
We do not collect personal information automatically, but we may tie this information to your Personal Information that we collect from other sources or you provide to us.
Do Not Track Signals
Some cell phones and tablets have a “Do Not Track” feature. This feature lets you tell Apps you visit that you do not want to have your geolocation activity tracked. The App is not currently set up to respond to those signals; however, we do not actively utilize, store, or track your geolocation or any geolocation data (see Data Accessed That We Do Not Collect below).
Google Analytics
We use a tool called “Google Analytics” to collect information about use of the Site. Google Analytics collects information such as how often users visit the Site, what pages they visit when they do so, and what other sites they used prior to coming to the Site. We use the information we get from Google Analytics only to improve the Site. Google Analytics collects only the IP address assigned to you on the date you visit the Site, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit the Site, the cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to the Site is restricted by the Google Analytics Terms of Use (as amended for government websites) and the Google Privacy Policy. You can prevent Google Analytics from recognizing you on return visits to the Site by disabling cookies on your browser. Please keep in mind that disabling cookies may alter your usability and the functionality of the Site.
How Do We Use the Information We Have Collected?
We use information that we collect about you or that you provide to us:
- To present to you the App and the Site and the services offered therein.
- To provide you with information or services that you request from us.
- To carry out our obligations and enforce our rights arising from any contracts entered into between you and us.
- To notify you about changes to the App or the Site.
- To allow you to participate in interactive features on the App or the Site.
- To respond to legal requests and to prevent harm (see When Will You Disclose My Information? below).
- To respond to user inquiries and offer user support.
- In any other way we may describe when you provide the information.
- For any other purpose with your consent.
When Will You Disclose My Information?
We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.
We may disclose Personal Information that we collect or you provide as described in this Policy:
- To contractors, service providers, and other third parties we use to support our business.
- To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which identifying information held by this App is among the assets transferred.
- To fulfill the purpose for which you provide it.
- For any other purpose disclosed by us when you provide the information.
- With your consent.
We may also disclose your Personal Information:
- To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
- To enforce or apply our End User License Agreement and other agreements we may have directly with you or a third-party.
- If we believe disclosure is necessary or appropriate to protect our rights, property, or safety, our customers, or others.
Data Accessed That We Do Not Collect
The App and the Site will ask you for permission to access your contacts and geographic location. We do not collect, store or download information from your contacts or your geographic location. The permissions you grant relating to your contacts or geographic location are used exclusively by the App and the Site to (a) accurately timestamp call recordings, (b) provide you with an access number to facilitate the recordation of phone calls through the App; and (c) facilitate the process of saving call recordings to the App.
Each call you record through the App is saved to your account portal where you can access these files in audio file in accordance with our record retention practices (see Record Retention below). These recordings are stored on our servers and, while we may be able to access and listen to such files, we do not collect any information from the content of the call recordings.
Canadian Individual Rights
The Personal Information Protection and Electronic Documents Act (“PIPEDA”) provides Canadian individuals with specific rights regarding their personal information. This section describes those PIPEDA rights and explains how to exercise them.
There are 10 principles of PIPEDA that guide this section of this Policy:
- Accountability: organizations are accountable for the Personal Information they collect, use, retain, and disclose in the course of their commercial activities, including, but not limited to, the appointment of a Chief Privacy Officer;
- Identifying Purposes: organizations are to explain the purposes for which the Personal Information is being used at the time of collection and can only be used for those purposes;
- Consent: organizations must obtain an individual’s express or implied consent when they collect, use, or disclose the individual’s Personal Information;
- Limiting Collection: the collection of Personal Information must be limited to only the amount and type that is reasonably necessary for the identified purposes;
- Limiting Use, Disclosure, and Retention: Personal Information must be used for only the identified purposes, and must not be disclosed to third parties unless the individual consents to the alternative use or disclosure;
- Accuracy: organizations are required to keep Personal Information in active files accurate and up-to-date;
- Safeguards: organizations are to use physical, organizational, and technological safeguards to protect Personal Information from unauthorized access or disclosure;
- Openness: organizations must inform their clients and train their employees about their privacy policies and procedures;
- Individual Access: an individual has a right to access Personal Information held by an organization and to challenge its accuracy if need be; and
- Provide Recourse: organizations are to inform clients and employees of how to bring a request for access, or complaint, to the Chief Privacy Officer, and respond promptly to a request or complaint by the individual.
Purposes of Collecting Personal Information; Limiting Use, Disclosure, and Retention
Personal Information will only be collected, utilized, and disclosed for the purposes set forth in How Do We Use the Information We Have Collected? and When Will You Disclose My Information? (above). Retention of Personal Information is covered in Record Retention below.
Consent
Your consent to the collection, use, and disclosure of your Personal Information is implied when you subscribe to the services offered through the App and the Site as set forth in the introductory paragraphs of this Policy. You may withdraw consent at any time; however, upon such withdrawal, you must submit a request to delete your account as set forth below in Account Deletion.
Limiting Collection
Personal Information collected will be limited to the purposes set forth in this Policy as may be amended from time to time.
Accuracy
Your Personal Information is tied to your Android account or Apple ID, which is automatically maintained by your relevant account with your mobile OS provider. Therefore, the accuracy of your Personal Information will automatically be maintained.
Safeguards
We use industry-standard technological measures to safeguard Personal Information. Our electronic databases and computers are password-protected. Our servers have firewall protection sufficient to protect personal and confidential business information.
Openness
We make this Policy known to the individual upon subscription to our services. This Policy is also available on the Site.
Individual Access
If you wish to review or verify what Personal Information is held by us, or to whom your Personal Information has been disclosed, you may make a request for access in writing to [email protected]. Upon verification of your identity, we will respond within sixty (60) days.
Complaints
You may ask questions or submit a complaint, in writing to [email protected] and, upon verification of your identity, investigate and respond to your complaint in a timely manner.
Applicability Outside the United States and Canada
The App and the Site is intended for use exclusively within the United States and Canada. Individuals residing outside of these jurisdictions are strongly discouraged from downloading, accessing, or utilizing the App or the Site in any manner. We do not represent that the App, the Site, or either of its content is appropriate, legal, or available for use in locations outside the United States and Canada. Those who choose to access or use the App or the Site from other locations do so on their own initiative and are responsible for compliance with local laws, including but not limited to export and import regulations. By using the App or the Site, you acknowledge and agree that you will not use or attempt to use the App or the Site from any territory where its contents are illegal or where we do not authorize such use.
Record Retention
We will only retain your Personal Information for as long as necessary to fulfill the purposes for which it was collected including satisfying any legal, accounting, or reporting requirements.
To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we process your Personal Information and whether we can achieve those purposes through other means, and the applicable legal requirements.
In some circumstances we may anonymize your Personal Information (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.
We may elect to automatically delete call recordings stored on our servers three (3) years from the date of its creation; however, we have no obligation to conduct such deletion for so long as your account remains open with us. Notwithstanding the foregoing, we may elect to delete call recordings at our sole discretion as set forth in the End User License Agreement. In the event you submit a request to delete your account, pursuant to Account Deletion below, we may delete your call recordings within ninety (90) days of successful account deletion.
Data Security
The transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to this App. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on this App.
The safety and security of your information also depends on you. Ensuring the email address associated with your account is secure is necessary to ensure no unauthorized access to your account is made by a third-party through our pin authentication protocol. We ask that you take the necessary precautions to safeguard your email address to ensure log-in authentication is a secure process. We are not responsible for your failure to ensure the security of your email address or any data leaks caused by your mobile device or email provider.
Account Deletion
You may permanently delete your account by either:
- Within the App, go to Settings > Delete Account > Confirm Deletion.
- You may also submit a support tick in the App on the support page requesting deletion or send an email requesting your account be deleted to [email protected]. Once we’ve confirmed receipt of your email, your account will be deleted within thirty (30) days.
Changes to Our Privacy Policy
It is our policy to post any changes we make to this Policy on this page. If we make material changes to how we treat our users’ Personal Information, we may notify you through a push notification or any other communication method we deem appropriate. The date this Policy was last revised is identified at the top of the page. You are responsible for periodically visiting this App and this Policy to check for any changes.
